Dog Friendly Restaurant Patios

Does anyone know why some restaurants with patios are dog friendly and some are not? I recently called a restaurant with a patio and asked if they were dog friendly. Their answer was that the health department only allowed them to have service dogs anywhere food was being served. How is it that one restaurant can have dogs on a patio where food is served, and another says they can't???
